North Carolina 811 requirements for fence installation

The dig law is the one regulation on this site that applies to every fence project without exception — no lot is exempt, no budget is too small, and no permit answers for it. This page is the statute's requirements end to end for fence work: what triggers it, what the clocks are, what happens after the call, and what the rules are when the marks meet the post line.

What triggers it. North Carolina's dig statute is the Underground Utility Safety and Damage Prevention Act, the Underground Utility Safety and Damage Prevention Act, enacted to protect the public and the workforce from the dangers of excavating where underground lines are buried — and its definition of excavation lists digging, auguring, driving, and drilling. Fence posts are dug, augered, driven, and drilled. There is no project type in fence work outside that list, and the statute does not carry a small-job exception for anyone, homeowner or contractor alike.

The notice and its clocks. notice 3 working days before digging — before commencing any excavation, notice of intent goes to the Notification Center no less than three full working days before the proposed start, and a notice expires twenty-eight calendar days after the work start date. Two clocks, both load-bearing: the three working days are measured in full days before the start, so the notice is filed the week the project is scheduled, not the morning of; and the twenty-eight-day life means a stalled project renews its ticket before the auger returns to the ground.

The system the notice enters. one statewide Notification Center — NC 811 — one Notification Center for the state, operated today as NC 811, which all utility operators must join, and which may not impose any charge on the person giving the notice. One contact, routed to every operator with facilities in the dig area, at no cost — the legislature bought the compliance rate with that last clause, and it shows in how painless the duty is.

What happens on the other side. operators mark within 3 working days — the facility operator must mark the horizontal location of its facilities in the proposed excavation area, using the APWA uniform color code, within three full working days, and provide positive response to the Center before the waiting period expires. The marks are estimates of horizontal location — which is why the statute also defines a tolerance zone around them, tolerance zone = 24 inches each side — twenty-four inches on either side of the line, plus half the known facility diameter, inside which mechanized digging waits until the facility is visually identified by hand.

The practical shape of a compliant fence job, in one paragraph: notice filed three working days ahead of the start; marks and positive response on the ground before the crew; posts planned to the marks with the tolerance zone hand-dug where the run crosses one; the ticket watched against its twenty-eight-day life if the schedule slips; and any line exposed rather than gambled with. That is the whole regime, it costs nothing but calendar, and it is the difference between a fence project and an incident report.
